This Privacy Policy informs you about how Netwrix Corporation and its subsidiaries (collectively, "Netwrix") collect, use, and share your personal information through our website (collectively the "Site"), or when you interact with us online, for instance through our branded social media pages; offline collection, including Netwrix events, surveys, questionnaires, research and evaluations; third-party sources, including business partners and vendors; or when you apply for an employment opportunity with Netwrix (collectively, the "Offerings").

When you submit your Personal Information to Netwrix through the Site or the Offerings, Netwrix is the controller of your personal information under this Privacy Policy, which means we are responsible for your personal information.

PERSONAL INFORMATION WE COLLECT

"Personal Information" generally means information that identifies you as an individual and other information we associate with it. We collect several types of Personal Information, from several sources, depending on the Offerings you use.

1. Personal Information we collect directly from you

We may collect Personal Information directly from you in the following situations:

  • Account information such as your name, business email address, phone number and other similar information when you create and use your account on our Site. We also collect details of your completed account profile and how you use your account, including any account settings and functionality.
  • Contact and Communication Information such as name, business email, phone number, address for you or others (e.g., principles in your business or billing contacts), and the content of your communications , when you interact with us, including through the Site, web forms, phone, email, post, social media or in person.
  • Customer Payment Information such as billing name and address, credit card number or bank account information. Please note that Netwrix does not directly collect or store your financial account information; instead, we use a reputable payment processing company to collect and process your payment information and have taken steps to ensure that it will protect such Personal Information in compliance applicable law and our Privacy Policy.
  • Marketing information. such as your preferences for receiving communications about our activities, services, and publications, and details about how you engage with our communications.
  • Event and Webinar Information such as name, registration details and details of the relevant event or webinar, when you register for, attend or participate in an event or webinar that we organize, host, sponsor or support. You may also be featured in videos and photographs from these events.
  • Vendor/Partner Information such as your name, company, job role, contact information and the content of your communications with us when you enter into a vendor or partnership agreement with us, or act as a representative of one of our vendors or partners.
  • Applicant Information. If you apply for an employment opportunity with Netwrix, we collect your name, email, phone number, address, and the information you provide in your application materials and during any interview process.
  • Reviews and Feedback. If you voluntarily submit certain information to us, such as by filling out a survey about your user experience, providing feedback, or submitting a review of our products, we collect the information that you have provided.
  • Other information. We may collect other Personal Information which is not specifically listed here, but which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

2. Automatically collected device and usage information

We use common information-gathering tools, such as cookies, web beacons, pixels, and similar technologies, to automatically collect information as you navigate our Site, our services, or interact with emails we have sent to you.

We may record certain information about visitors to our Site, including the web request, interaction with the Site including pages and files viewed, date and time stamp, IP address, language preference, location (depending on your device and browser settings), device and mobile identifiers, browser information, operating system and configuration, Internet service provider and/or mobile carrier, referring website, and other such information. This information is used to analyze overall trends, help us provide and improve our Site and products and services, provide a tailored experience to users, and to secure and maintain our Site.

We may also collect similar information from emails you receive from us that can help us track which emails are opened and which links are clicked by recipients.

3. Information we receive from third parties

We also collect some Personal Information from third parties in the following scenarios:.

  • Lead generation and business information providers. We may collect Personal Information from third-party sources that compile or provide business contact and lead information for sales, marketing, and business development purposes. These sources may include publicly available databases, professional directories, or vendors that lawfully provide such information to us. The Personal Information collected typically includes your name, professional contact details, job title, employer, and industry. We use this information in accordance with applicable data protection laws to identify and engage with prospective customers, partners, and suppliers.
  • Social media information. We maintain pages on social media platforms, such as Linkedin, X, Facebook, YouTube, Spiceworks and Instagram. When you visit or interact with our pages on these platforms, or post about us, we collect Personal Information that you choose to provide to us, such as your contact details and the content of your interaction. The platform providers may also provide us with information and analytics about interactions involving our social media pages. Please note that these platforms are separate controllers of your Personal Information and have their own privacy policies, which apply to your interactions with them and to their collection, use, and processing of your Personal Information.
  • Recruitment - Referrals, Job Boards and Public Professional Networks. We may collect your Personal Information where you have been referred to us by a third party for potential employment (e.g. a recruitment provider or a contact who is an employee) or from your public profile on job boards or professional networks (e.g. LinkedIn) where it is lawful to do so and if we think you may be a good fit for a job role at Netwrix. This is generally information including name, email, phone number, education and job history, CV and application details.
  • Business transaction information. We may receive Personal Information in connection with strategic transactions, such as mergers, acquisitions, investments in, or purchases of other companies, establishments, assets or brands. In such cases, the relevant parties may share Personal Information about you with us as part of the transaction process, typically limited to operational details such as names, contact information, service history and transaction records.

HOW WE USE PERSONAL INFORMATION

We use Personal Information as permitted by law and for the following businesses purposes:

  • Provide our Offerings. It is in our legitimate business interests to use Personal Information to operate, maintain, and provide access to our Offerings, including products, services, training, and support services. This includes processing and fulfilling orders or transactions, managing user accounts, delivering training, providing technical and customer support, and invoicing for our services. Where we have entered into a contract with you, we will use your Personal Information as required to perform our contractual obligations, including under our Terms of Service.
  • Communicate with you about our Offerings. It is in our legitimate business interests to use Personal Information to respond to your requests, questions and feedback, and to communicate with you about our Offerings and the Site where appropriate, including by sending you announcements, updates, security alerts, and support and administrative messages relating to your account status, order confirmations, renewal or expiration noticesand other important information.
  • Marketing, Sales and Advertising
    • Direct Marketing. We may send you direct marketing communications we think may be of interest to you as permitted by law, including by email. You can opt-out of our marketing communications by clicking the unsubscribe link in communications we send you or by contacting us. We will only send you marketing communications if you consent to receiving these communications or if we are permitted to send these communications under law in our legitimate business interests.
    • Sales Activities. It is in our legitimate business interests to conduct our advertising, marketing and sales activities, including sending promotional materials, generating leads, pursuing marketing prospects, performing market research, determining and managing the effectiveness of our advertising and marketing campaigns and managing our brand.
    • Interest-based Advertising. We engage our advertising partners, including third party advertising companies and social media companies, to display ads around the web. These companies may use cookies and similar technologies to collect information (including the automatically-collected data described above) about your interactions over time across our Site, our communications, and other online services, and use that information to serve online ads that may interest you. Where required by law we will undertake such advertising activities on the basis of your consent, otherwise we will do so only if it is in our legitimate business interests to undertake such activities.
  • Events, Webinars and Promotional Activities. It is in our legitimate interests to use your Personal Information to complete and manage your registration and participation in events, webinars, programs and other promotional activities that we organize, host, sponsor or support. This includes sending confirmations and updates, granting access, reviewing entries or submissions, and managing logistics and communications.
  • Event photos and video footage. Where you attend any event or program that we organize, host, sponsor or support, and photographs or videos are taken on our behalf, we may use images or video in which you appear for marketing, advertising and promotional purposes. This may include publication on our website, social media or in printed materials. We do this based on our legitimate interests. If you would like us to remove a photo or video, please contact us with details of the event or program and, if possible, a copy or description of the content.
  • Reviews and feedback. It is in our legitimate business interests to conduct surveys and collect feedback, including reviews.When you choose to complete our surveys, submit a review about us or provide any other feedback, we process the Personal Information you provide to help us understand and improve our Offerings, and monitor service quality.
  • Supplier and partner relationships. If you are a supplier or partner, or a representative of one, it is in our legitimate business interests to use your Personal Information to communicate with you and manage our relationship with you or your organization. Where we have entered into a contract with you or your organization, we will also process your Personal Information as necessary to perform our contractual obligations.
  • Business operations and administration. It is in our legitimate business interests to use Personal Information to manage and support our internal business operations. This includes activities such as accounting, auditing, billing, reconciliation and collection, contract and vendor management, and general administrative functions.
  • Improve, monitor, personalize, and protect our Services. It is in our legitimate business interests to improve and keep our Offerings safe for our users, which includes: (i) understanding your needs and interests, and personalizing your experience with the Offerings and our communications; (ii) troubleshooting, testing and research to keep the Offerings secure; (iii) maintain and enhance the security of our Site and other online channels, products, services, and information resources; and (iii) investigating and protecting against fraudulent, harmful, unauthorized or illegal activity.
  • Research and development. We may use Personal Information for research and development purposes in our legitimate business interests, including to analyze and improve the Offerings and our business. This may include data analytics such as research, trend analysis, and financial analysis. As part of these activities, we may create or use aggregated, de-identified or other anonymized data from Personal Information we collect. We make Personal Information into anonymized data by removing information that makes the data personally identifiable to you. We may use this anonymized data and disclose it to third parties for our lawful business purposes, including to analyze, improve or add features to our Offerings, and to promote our business.
  • Compliance and protection. We may use Personal Information to comply with legal obligations, and to defend us against legal claims or disputes where it is in our legitimate business interests to do so, including to: (i) protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); (ii) audit our internal processes for compliance with legal and contractual requirements and internal policies; (iii) enforce the terms and conditions that govern the Offerings; (iv) prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft; and (v) comply with applicable laws, lawful requests and legal process, such as to respond to subpoenas or requests from government authorities.
  • Recruitment: Assessing You and Communicating With You About The Recruitment Process. In the interest of taking steps, at your request, to facilitate entering into a hiring contract with you, we process your Personal Information to assess your qualifications, experience and capabilities, and how they may align with the needs of Netwrix as part of our candidate recruitment process. Additionally, we use your Personal Information to communicate with you about the recruitment process, including providing updates on your application status, scheduling interviews and providing feedback from interviews and assessments. For Personal Information that we have collected from third-party sources before contacting you (e.g. LinkedIn), we rely on our legitimate interests to assess your suitability for a job role with Netwrix.
  • Recruitment: Reasonable adjustments. Where required by law, or where you have provided your explicit consent, we may use your Personal Information to make reasonable adjustments or accommodations during the recruitment process. This may include information about any disabilities or medical conditions you have chosen to disclose to us. We do this to ensure equal access and opportunity throughout the hiring process.

DISCLOSURE OF PERSONAL INFORMATION

Depending on your use of the Offerings, we may share Personal Information with the following entities:

  • Within Netwrix, including our affiliates and subsidiaries, for the purposes described in this Privacy Policy;
  • Third party service providers we have engaged to perform services on our behalf, such as website and blog hosting, recruiting, data analysis, research and analytics, marketing, event planning, payment processing, infrastructure provision, IT services, customer support/service, email delivery services, data analytics, and other such services to us, and for the purposes of providing those services;
  • Professional advisers acting as service providers, including lawyers, bankers, auditors, and insurers based in the countries in which we operate, and who provide consultancy, banking, legal, insurance, accounting, audit/compliance and similar services;
  • Customers, for instance to connect authorized users of our products and services with their company administrator, to report and help manage issues requiring support, to verify account or activity information, investigating suspicious activity, or enforcing our terms and policies;
  • Other users of the Offerings where you have chosen to submit or share Personal Information, for instance in the community forum, comments on our blogs, or reviews of our products;
  • With relevant partners, sponsors or co-organisers of event, webinars, programs and other promotional activities we organise, host, sponsor or support as required to manage participation. Such sharing will always be subject to appropriate safeguards, and where required by law, we will obtain your consent before doing so;
  • Our sales partners, including distributors and authorized resellers of our products and services, to offer and provide our products and services to you;
  • Our advertising and analytics providers to support interest-based advertising and performance tracking, as described in the “Marketing, Sales and Advertising” section above;
  • To a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings);
  • To law enforcement, government authorities and private parties, comply with legal obligations and as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above; and
  • To other relevant third parties, where you give us permission or an instruction to do so in the course of your relationship with us from time to time.

RETENTION OF PERSONAL INFORMATION

We retain Personal Information only for as long as is necessary to fulfil the purposes described in this Privacy Policy, including to provide the Offerings and where we have a legitimate business need to do so, such as where the retention is required by law or regulatory obligations (e.g. tax, legal, accounting or health and safety purposes), to enforce and prevent violations of our terms and policies, or to defend against legal claims.

To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorised use or disclosure of Personal Information, the purposes for which we use Personal Information and whether we can achieve those purposes through other means, any permissions you give us with regards to your Personal Information, and the applicable legal and regulatory requirements.

INTERNATIONAL TRANSFERS

As we are headquartered in the United States, your Personal Information will be processed in the United States. We may also transfer Personal Information to our affiliates and service providers located in the United States and other jurisdictions. Please note that these jurisdictions may not offer the same level of protection as the data protection laws in your home country.

Where we transfer Personal Information across borders, we implement appropriate safeguards to ensure it is adequately protected and comply with applicable data protection laws. These safeguards may include reliance on adequacy decisions (where a jurisdiction is recognised as providing an adequate level of protection by competent data protection authorities such as the European Commission, the UK government, or similar regulators) or the use of standard contractual clauses or other lawful transfer mechanisms approved by such authorities.

ANALYTICS, COOKIES AND SIMILAR TECHNOLOGIES

Netwrix uses technologies such as web beacons, pixels, and tags, alone or in conjunction with cookies, to gather information about the use of our Site and how people interact with our emails. A "cookie" is a text file that websites send to a visitor’s computer or other Internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. A "web beacon," also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their cookies and may be used to transmit information collected through cookies back to a web server.

Third Party Services

Third parties provide certain services available on this website. We may provide information, including Personal Information that we collect on the Web to third-party service providers to help us deliver programs, products, information, and services. Service providers are also an important means by which we maintain our website and mailing lists. We will take reasonable steps to ensure that these third-party service providers are obligated to protect Personal Information on our behalf. We do not intend to transfer Personal Information without your consent to third parties who are not bound to act on our behalf unless such transfer is legally required. Similarly, it is against our policy to sell Personal Information collected online without consent.

When you visit the Site, we, or an authorized third party, may place a cookie on your device that collects information, including IP address and other identifiers associated with your device and device characteristics, or your activity on the Site. Cookies allow us to monitor Site usage, identify trends and track statistics, and improve and customize your experience. We also use web beacons and pixels on our Site and in emails. For example, we may place a pixel in marketing emails that lets us know when you click on a link in the email. Do Not Track

We do not monitor or follow "Do Not Track" (DNT) signals because there is no standard interpretation or practice for DNT signals. Therefore, we handle all user information consistent with this Privacy Policy.

The Site may contain links to other websites, applications, and services maintained by third parties. These links are provided for your convenience only. The information practices of other services, or of social media platforms that host our branded social media pages, are governed by the privacy policies and terms of use of those entities.

The providers of third-party apps, tools, widgets and plug-ins on our online channels (such as Twitter, LinkedIn and Facebook) also may use automated means to collect information regarding your interactions with these features. This information is collected directly by the providers of the features and is subject to the privacy policies or notices of these providers. To the extent permitted by applicable law, Netwrix is not responsible for these providers’ information practices.

SECURITY

Wherever your Personal Information is held by Netwrix or on its behalf, we will take reasonable and appropriate steps to protect it from unauthorized access or disclosure.

CHILDREN’S PRIVACY

The Site and our products and services are not intended for use by children and Netwrix does not knowingly collect Personal Information from anyone under 13 years of age.

YOUR RIGHTS AND CHOICES

Updating Your Information

To the extent that you provide us with Personal Information, we wish to maintain accurate records, and should you need to update or correct that Information, you may contact us as indicated below and we will make reasonable efforts to update your Personal Information as soon as practicable.

Opting Out of Marketing Communications

You may opt out of receiving promotional or email marketing communications from or on behalf of Netwrix by clicking "unsubscribe" at the bottom of any email. We may still continue to send you certain emails relating to use of the Site, service announcements, or similar administrative or transactional messages.

CALIFORNIA PRIVACY RIGHTS AND DISCLOSURES

California residents have certain additional rights under state law.

Right to Know

If you are a California resident, you have the right to know certain information about our data practices in the preceding 12 months. In particular, you have the right to request the following from us:

  • The categories of Personal Information we have collected about you;
  • The categories of sources from which the Personal Information was collected;
  • The categories of Personal Information about you that we have disclosed;
  • The categories of third parties to whom Personal Information was disclosed;
  • The business or commercial purpose for collecting or selling (if applicable) the Personal Information; and
  • The specific pieces of Personal Information we have collected about you.

Right to Delete

If you are a California resident, you may request that we delete your Personal Information. Note that deletion requests are subject to certain limitations, for example, we may retain personal information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, and to process transactions and facilitate customer requests.

Exercising Your Rights

To exercise your rights, please submit a request by emailing us at privacy@netwrix.com. In your request, please specify which right you are seeking to exercise and the scope of the request. We may require specific information from you to help us verify your identity and process your request, in which case we will contact you at the email address you provide.

California residents may designate an authorized agent to submit requests on your behalf. We will require written proof of the agent’s permission to do so and will verify your identity directly with you.

We will not discriminate against you in price or service for exercising your rights.

No Sales of Personal Information

Netwrix does not sell Personal Information of California consumers nor do we disclose the Personal Information of Netwrix’s California customers to third parties for their direct marketing purposes.

EUROPEAN PRIVACY RIGHTS

If you are located in the UK or EEA, you have the following rights under the General Data Protection Regulation (subject to certain conditions and exceptions) when it comes to your Personal Information:

  • Access to a copy of the Personal Information that we have collected about you and information on how we have used your Personal Information.
  • Portability of your Personal Information (i.e. to provide Personal Information in a portable, machine-readable, readily usable format to you or another third party you designate).
  • Correction of Personal Information that is inaccurate or out of date.
  • Deletion of Personal Information that we no longer need to provide the Service or for other lawful purposes.
  • Objection to us processing your Personal Information where we rely on our legitimate business interest to do so (see above) or for any direct marketing purposes (e.g. to send you newsletters or promotional emails, or for targeted online advertising purposes described above).
  • Withdraw your consent to our processing of your Personal Information at any time where we rely on your consent to process that Personal Information. This won’t affect anything we have used your Personal Information for before you withdraw your consent.
  • Right to complain. You have the right to lodge a complaint about the way we handle or process your Personal Information with the UK/EEA data protection regulator in the country where you live or work, or where you believe your data protection rights have been violated.

CHANGES TO THIS PRIVACY POLICY

We may amend this Privacy Policy from time to time. Please reference the date at the top of this page to see when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on our Site. To the extent permitted by law, your use of the Site following these changes means that you accept the revised Privacy Policy.
